These general terms of sale (hereinafter referred to as "TOS") aim to define the conditions for the remote sale of products by WATTS, registered with the Aix-en-Provence Trade and Companies Register under number 805 282 589 (hereinafter referred to as "WATTS"), to any non-trading, adult individual (hereinafter referred to as "the Buyer") making a purchase on the website www.watts-team.com (hereinafter referred to as "the Website").

Placing an order implies the Buyer’s full and unreserved acceptance of these terms of sale. Any contrary conditions presented by the Buyer shall, unless expressly accepted, be unenforceable against WATTS, regardless of when they were brought to its attention.

The fact that WATTS does not invoke any provision of these TOS at a given time shall not be interpreted as a waiver of the right to invoke it later.

These TOS, written in French, detail the various steps involved in placing an order, as well as the terms of payment, delivery, and order tracking.

ARTICLE 2 – PRODUCTS

The products offered for sale by WATTS are those displayed on the Website at the time of the Buyer's visit (hereinafter referred to as "Products"). WATTS reserves the right to add new Products, remove any or all Products, or modify their presentation at any time without specific notification to users.

Products are described as accurately as possible to provide a complete and faithful description. However, due to the digital presentation of Products on the Internet, the Buyer’s perception of the photographic representation may not perfectly match the actual Product.

WATTS undertakes to deliver Products that comply with current safety and health regulations, in particular, European legislation on regulated chemical substances.

ARTICLE 3 – PRICING

Product prices are those displayed on the Website at the time of the Buyer's visit.

Delivery fees are specified during the order process. Customs fees, however, depend on the purchase amount and are only known upon delivery.

Products remain the property of WATTS until full payment is received.

ARTICLE 4 – ORDERING

Placing an order implies acceptance of the prices and descriptions of the Products available for sale.

WATTS commits to fulfilling orders only within the limits of available stock. If a Product is unavailable, WATTS will notify the Buyer via email as soon as possible. The order for the unavailable Product will automatically be canceled.

ARTICLE 7 – CLAIMS AND RETURNS

7.1 Legal Warranty of Product Conformity and Warranty Against Hidden Defects

All Products are covered by the legal warranty of conformity (Article L.217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Article 1641 et seq. of the French Civil Code), allowing the Buyer to return delivered Products that are defective or non-compliant.

In the event of delivery of a Product that does not conform to the order or reveals a hidden defect, the Buyer must return the Product to the address provided by WATTS and first contact customer service via email at contact@watts-team.com. In the case of non-conformity, the return shipping costs, as well as any costs for delivering a replacement Product, will be borne by WATTS.

The Buyer must retain proof of the return. WATTS may refuse to refund the Buyer or exchange the Product if it has not received the returned Product and the Buyer cannot provide proof of shipment.

The Buyer may request a refund of the price of the ordered Product from WATTS. The refund will be processed within 30 days of WATTS receiving the returned Product, credited to the bank account used for payment, the PayPal account if the order was paid via PayPal, or the gift card used for payment. WATTS will refund the returned Product at the invoiced price.

In any case, these provisions do not prevent the Buyer from exercising their right of withdrawal, as outlined in Article 7.2 below.

7.2 Right of Withdrawal

In accordance with Article L.221-18 of the French Consumer Code, the Buyer has a period of 14 (fourteen) days from the date of receipt of the ordered Products to inform WATTS of their intention to return one or more Products without having to provide a reason or pay any penalties, except for return shipping costs.

After this period, the delivered Products will be considered accepted by the Buyer. WATTS may refuse to refund the Buyer if it has not received the returned Product and the Buyer cannot provide proof of shipment. The Buyer is responsible for retaining proof of the return.

To facilitate processing, the Buyer must include the return form, which will be sent by email after the return request, and the delivery note included in the package, duly completed.

The Buyer will be refunded the total order amount at the invoiced price, excluding delivery costs, within 30 days of WATTS receiving the returned Products. The refund will be credited to the bank account corresponding to the card used for payment, the PayPal account if paid via PayPal, or the gift card.

7.3 Conditions for Returns

WATTS does not accept or exchange Products purchased from reseller stores. If you wish to exchange or refund your purchases, you must return to the store where the purchase was made.

WATTS’s after-sales service only applies to Products purchased on the website www.watts-team.com.

Returned Products must be new, unused, in their original packaging, and with the original tag attached to the Product. Any item returned without meeting these conditions will not be accepted. Upon receipt of the package, WATTS will assess the condition of the returned Product(s). Returns will not be accepted if the Products have been visibly used or damaged by the Buyer, rendering them unsuitable for resale.

If the return is refused by WATTS, the Products will be made available to the Buyer at their expense, without the Buyer being able to claim any compensation or refund, except for the later exercise of warranty rights on the sold Products.

ARTICLE 8 – COUNTERFEITING AND UNFAIR COMPETITION

The Buyer is prohibited from reproducing, in whole or in part, the designs of the Products they have purchased or seen on the Website, under penalty of legal action.

ARTICLE 9 – DISPUTES AND JURISDICTION
